Nursery Brands Expand Patent & Trademark Monitoring Effort

Friday, December 7, 2012

Dearborn, MI Nursery inspections are under way from New Jersey to Oregon and Michigan to Louisiana as Spring Meadow Nursery, Bailey Nurseries, Star Roses and Plants/The Conard-Pyle Company and Plant Development Services Inc. expand their patent and trademark monitoring efforts through Plant Watch nationwide.

Each year we do this inspection program, the value of the brands and patents becomes more clear to growers," says Jacques Ferare of Star Roses/Conard-Pyle, developers of The Knock Out Family of Roses brand. "We've worked hard to establish our brands, and spend tens of thousands of dollars on patents. Enforcing these intellectual property rights is necessary to support our customers and licensees, and ensures that compliance is improving." Other brands included in the inspection are Proven Winners ColorChoice, Encore Azaleas, the Endless Summer Collection, First Editions, Drift Roses and the Southern Living Plant Collection.

Nurseries found to be non-compliant are assessed a significant fine based on the number of unauthorized plants, which are then destroyed.
